OFFICIAL RULES

TO ENTER: NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  Two ways to enter: (a) Each time you use your ShopRite® Price Plus Club Card® to purchase any New York Style® product, you will automatically have an entry entered for the Broadway! New York Style® / ShopRite® Sweepstakes, OR TO ENTER WITHOUT MAKING A PURCHASE (b) print your name, address (including zip code), home and work telephone numbers and email address on a postcard and mail it postage paid to Broadway! New York Style® / ShopRite® Sweepstakes Entry, PO Box 42142, Cincinnati, OH, 45242.

ENTRY PERIOD: The Sweepstakes begins May 11, 2009 at 12:00 a.m. Eastern Time (“ET”) and ends June 30, 2009 at 11:59 p.m. ET (“Entry Period”).  No facsimiles or mechanically reproduced entries accepted. All entries must be received by 11:59 PM ET on June 30, 2009. By entering this Sweepstakes, entrants accept and agree to be bound by these rules and the decisions of the judges, which shall be final on all matters.  All entries received after valid dates are void and ineligible for prize.  All entries become the property of Nonni's Food Company ("Sponsor") and none will be acknowledged or returned.  Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.  Sponsor is not responsible for lost, late, misdirected, mutilated, incomplete or postage-due mail or entries.

PRIZES AND ODDS OF WINNING:  One (1) Grand Prize to be  awarded is a 3-day/2-night trip for Two (2) to New York City to see a Broadway show, including round-trip coach air transportation from major airport nearest winner’s home serviced by Continental Airlines, hotel accommodations (1 room, double occupancy; hotel tax included), a pair of Two (2) tickets to winner’s choice of a Broadway show (from a Sponsor-specified list of available shows) and $750.00 spending money for winner (ARV:  $2,850.00 per prize), depending upon winner's point of travel origin and airfare fluctuations at the time of taking the trip. Selection of hotel is solely within Sponsor’s discretion.  All other expenses not specifically mentioned herein including, but not limited to tips, meals, gratuities and ground transportation, are solely the responsibility of winner.  Sponsor has the right to substitute ground transportation for air travel if winner's home is within 150 miles or less of New York City, any resulting difference in ARV will not be awarded.  All travel must be taken on dates specified by Sponsor; no alternative travel dates are available or prize will be forfeited and may be awarded to an alternate.  All travel subject to availability and restrictions. Winner and travel guest must travel on same itinerary.  If winner is a minor in his/her state of residence, the travel guest must be winner’s parent or legal guardian.  A minor may accompany winner as a travel guest only if the winner is the minor’s parent or legal guardian.  Minors must be accompanied at all times during trip (including, but not limited to, in-flight, hotel stay and all prize-related events) by minor’s parent or legal guardian.  Travel guests must sign and return a travel release before any ticketing of travel occurs.  Winner and guest must have all necessary identification and/or travel documents (e.g., a valid U.S. driver’s license) required for travel.  Winner must claim their prize by August 10, 2009 and travel must be completed by June 30, 2010.  No substitution of prize offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value, except Sponsor at its sole discretion may substitute prize of equal or greater value.    All taxes, and any other fees and expenses not specified, associated with receipt or use of the prize, are the sole responsibility of the winner.  Winner will receive a 1099 IRS form from Sponsor for the prize.  Unclaimed prizes will not be awarded. Odds of winning will depend upon the number of eligible entries received.

DRAWING:  Winner will be selected in a random drawing to be conducted on or about July 15, 2009 from among all eligible entries received.  The Drawing will be conducted by ShopRite® whose decisions are final in all matters relating to this promotion.  Winners will be notified by phone or by mail on or about July 20, 2009 and may be required to execute and return an Affidavit of Eligibility/Liability/Publicity Release within 14 days after notification date or prize may be forfeited.  If prize notification is returned as undeliverable or winner cannot be located or does not respond by deadline date, an alternative winner will be chosen and prize will be awarded. 

ELIGIBILITY: Open to legal residents of CT, NY, NJ, PA or DE, 18 years or older at time of entry.  Employees, officers and directors (and their immediate family or household members, whether or not related) of Nonni’s Food Company, Inc., Wakefern Food Corp., any company that owns or operates a ShopRite® Supermarket and their subsidiaries, affiliates, stockholders, advertising agencies, promotion agencies, and dealers are not eligible.  Void outside of CT, NY, NJ, PA and DE, where prohibited, taxed or otherwise restricted by law.  All Federal, State and Local laws and regulations apply.  Prize will only be awarded if winner complies with official rules.  All entries become the property of the Sponsors. 

GENERAL CONDITIONS:  Entry constitutes winner’s permission to use their name, photograph and/or voice recordings for publicity purposes, in any and all media, without additional compensation or permission except where prohibited by law.  Sponsor is not responsible for computer system, network, hardware, software or program malfunctions, or other errors, failures or delays in electronic transmissions or network connections that are human or technical in nature. All entrants agree to release and forever discharge Nonni’s Food Company, Inc., Wakefern Food Corp. any company that owns or operates a ShopRite® Supermarket, and their respective subsidiaries, affiliates, stockholders, distributors, advertising, promotion and advertising agencies and their affiliates and subsidiaries and the respective employees, directors and officers of the foregoing entities from any and all claims, demands, losses and liabilities, of any nature whatsoever, which they may now or hereafter assert, including but not limited to, claims for injury, death, damages, or illness arising out of or claimed to be arising out of sweepstakes entry, prize acceptance, or use or misuse of the prize. As a condition of entering, entrants (or their parent or legal guardian if an eligible minor) agree (and agree to confirm in writing): (a) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (b) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (c) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.  Sponsor and its agents are not responsible for any printing or other errors in Sweepstakes related material.  Sponsor reserves the right, in their sole discretion, to cancel or suspend this Sweepstakes and award the prizes in a random drawing from among all eligible entries received prior to such action, should causes beyond the control of Sponsor corrupt the administration, security, or proper play of the Sweepstakes.  Information provided by the consumer will be used according to the terms of Sponsor's Privacy Policy, available at http://www.newyorkstyle.com/privacypolicy.php. 

GOVERNING LAW:  By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Oklahoma, without giving effect to any choice of law or conflict of law rules.  By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for Tulsa County, Oklahoma.
